Renter Information

Terms and Conditions of Rental

Parties

This agreement is between 1577819 B.C. Ltd., doing business as Eight North ("the Shop"), and the renter named below.

Assumption of Risk

The renter acknowledges that scuba diving involves inherent risks, including drowning, decompression sickness, equipment malfunction, injury, and death, regardless of cause, and voluntarily assumes all such risks.

Release of Liability

In exchange for renting this equipment, the renter releases and indemnifies the Shop, its owners, employees, and agents from all liability, claims, and damages arising from use of the equipment, including claims based on the Shop's negligence, except for the Shop's gross negligence, willful misconduct, or liability that cannot be excluded by law.

Certification

The renter confirms they hold a current, valid certification appropriate to this equipment, and that the certification number below is accurate. False or expired certification voids any claim against the Shop and may make the renter liable for resulting damage, injury, or loss. Equipment is for the renter's personal use only and may not be given to another person.

Minors

Renters under 19 require a parent or legal guardian's signature, binding them to all terms including the assumption of risk and release of liability.

Payment

A pre-authorization hold may be placed on the renter's credit card as security for the equipment's safe and clean return. The Shop does not retain the card's CVC beyond the transaction.

Equipment Condition

Staff will check equipment for performance deficiencies before departure and upon return. The renter confirms the equipment is in good working order and free of material damage at pickup. The renter is responsible for all damage, loss, or breakage of the gear and must immediately stop using any equipment that becomes unsafe or falls into disrepair. Damage resulting from misuse or unsafe transport is subject to repair costs or replacement value.

Responsibility for Damage

The renter will pay fair market value — the Shop's current retail replacement cost, less reasonable depreciation — for any lost or damaged equipment. Equipment returned unclean incurs a $35.00 cleaning fee. Tanks returned below 500 psi require a visual inspection at the renter's cost of $25.00.

Late Fees

Equipment not returned within the specified period, or without prior arrangement, incurs a late fee of $35.00/day in addition to the daily rental rate, charged to the credit card on file. If not returned and the Shop is not notified, the equipment's fair market value will be charged instead.

Term

This agreement remains in effect until all goods are returned and accounted for. Its releases and waivers survive return of the equipment and termination of this agreement.

Governing Law

This agreement is governed by the laws of British Columbia and Canada. Disputes are subject to the exclusive jurisdiction of the BC courts.

Severability

If any provision is found invalid or unenforceable, it will be severed, and the remainder of the agreement remains in effect.
